By proceeding with payment, ticking the acceptance checkbox and/or accepting the equipment at handover, the Hirer confirms they have read, understood and agree to be bound by these Terms & Conditions.
The rental period begins once the pre-rental inspection has been completed and the equipment is handed over to and accepted by the Hirer.
The rental period ends when the equipment is returned to Zintra Equipment at the agreed return location and time. The post-rental inspection may be completed after the rental period has ended to assess the condition of the equipment, identify damage, missing items, cleaning requirements or other applicable charges.
If the equipment is returned after the agreed return date or time, the Hirer will be charged one additional full day's rental fee at the applicable daily rate. Further daily rental charges will continue to apply for each additional day or part thereof until the equipment is returned.
Any applicable late-return charge may be deducted from the Hirer's security bond or pre-authorisation. The Hirer will be notified of the charge before the deduction is processed.
By ticking the acceptance checkbox and/or completing payment on Zintra Equipment's website, the Hirer provides a legally binding electronic acceptance in accordance with applicable Victorian law, and these Terms & Conditions take effect as an agreement between the Hirer and Zintra Equipment.
The Hirer confirms that they are at least 18 years of age and, where hiring on behalf of a business or organisation, that they are authorised to bind that business to these Terms & Conditions.
Full responsibility for the equipment, including theft, damage, misuse or loss, transfers to the Hirer upon handover and remains with the Hirer until the equipment is returned to Zintra Equipment.
The Hirer agrees to pay all rental fees, delivery/collection charges (if applicable), security bond and any additional charges stated in the booking, quote or invoice. GST treatment will be as displayed on the applicable booking, quote or invoice.
If delivery and collection is carried out by Zintra Equipment, Zintra Equipment accepts responsibility for damage that occurs during its transit.
If the Hirer arranges their own transport, delivery or collection, the Hirer is responsible for damage occurring during transit, including loading, unloading and handling by the Hirer or any third party engaged by the Hirer.
Additional charges may apply for late returns, excessive cleaning, repairs due to damage or misuse, loss of hire while the machine is under repair, missing items, refuelling/charging requirements, and full replacement where equipment is lost, stolen or beyond repair.
A security bond will be held via Stripe as a pre-authorisation on the Hirer's nominated card prior to handover. The bond amount will be stated on the relevant product booking page, quote or booking confirmation.
The security bond may be applied toward amounts reasonably payable under this agreement, including damage or repairs; excessive cleaning or contaminated/dirty tanks; missing or damaged accessories; missing chargers, keys, hoses, brushes, pads, squeegee assemblies or other supplied items; fuel replacement or refuelling charges; battery or charging-related charges where applicable; late-return charges; loss of equipment; and other charges agreed under these Terms & Conditions.
Where Zintra Equipment proposes to deduct an amount from the bond, the Hirer will be notified of the charge and the reason for it.
For damage or repair costs, Zintra Equipment will provide the Hirer with details and/or a repair or replacement quote. The Hirer has 3 business days from the date the information is provided to accept or dispute the amount.
If the Hirer accepts the amount, the applicable cost may be deducted from the bond, with any remaining balance released. If the amount exceeds the bond, the remaining balance must be paid within 7 days of invoice.
If the Hirer does not respond within 3 business days, or an outstanding balance remains unpaid, Zintra Equipment reserves its rights to pursue recovery in accordance with these Terms & Conditions.
Where no damage, loss, missing items, cleaning charges, late fees or other outstanding charges are identified following the post-rental inspection, the bond pre-authorisation will be released.
The Hirer must complete Zintra Equipment's required identity verification process, including valid photo identification and business details where applicable, before release of equipment. Zintra Equipment may refuse hire where verification is incomplete or unsuccessful.
The Hirer must not sub-rent, lend, transfer or allow any third party to use the equipment without prior written approval from Zintra Equipment. The Hirer remains responsible for the equipment throughout the rental period.
Cancellations made more than 24 hours before the scheduled delivery or pickup time will receive a full refund.
Cancellations made less than 24 hours before the scheduled delivery or pickup time will receive a 50% refund. The remaining 50% may be retained by Zintra Equipment to cover transport, preparation and scheduling costs.
All cancellations must be communicated directly to Zintra Equipment. The time of notification will determine which cancellation policy applies.
All invoices must be paid within the agreed payment terms stated on the quote or invoice. If payment is not received by the due date, Zintra Equipment reserves the right to apply lawful late payment fees and pursue reasonable recovery costs, subject to applicable law.
If an amount remains unpaid, Zintra Equipment may refer the matter to a debt collection agency or legal recovery process and seek recovery of costs to the extent permitted by law.
If the Hirer breaches these Terms & Conditions, including non-payment, misuse, unauthorised sub-hiring or failure to return the equipment, Zintra Equipment reserves the right to take lawful steps to recover the equipment. The Hirer must provide reasonable access to the equipment where legally permitted.
Zintra Equipment may complete a pre-rental inspection before handover and record the condition of the equipment using photographs, video, timestamps and/or an electronic inspection report.
The Hirer must inspect the equipment at handover and identify any visible damage, missing accessories or other issues before accepting the equipment.
By accepting the equipment, the Hirer acknowledges its recorded condition except for any issue reported and documented at handover.
Zintra Equipment may complete a post-rental inspection after the equipment is returned. Photographs, videos, timestamps, electronic inspection reports, handover records and return records may be used to compare the condition of the equipment before and after the rental.
New damage, missing equipment or accessories, excessive cleaning requirements or other issues identified during the post-rental inspection may be charged in accordance with these Terms & Conditions.
If equipment stops working through no fault of the Hirer, Zintra Equipment will endeavour to resolve the issue as quickly as reasonably possible by providing a replacement machine of equivalent specification where available, or applying an appropriate adjustment to the rental fee for reasonable downtime.
The Hirer must notify Zintra Equipment immediately upon becoming aware of any fault or breakdown.
If the Hirer becomes aware of abnormal operation, a warning indicator, unusual noise, leak, electrical issue or another condition that may create a safety risk or cause further damage, the Hirer must immediately stop using the equipment and notify Zintra Equipment.
No compensation, adjustment or replacement will be provided for downtime where Zintra Equipment was not promptly notified. To the extent permitted by law, Zintra Equipment will not be responsible for consequential loss, project delays or additional costs arising from equipment breakdown.
Only trained and competent operators may use the equipment. Damage caused by incorrect use may be charged to the Hirer at the reasonable repair or replacement cost.
The Hirer must use only manufacturer-approved or Zintra Equipment-approved chemicals and consumables and must follow recommended chemical concentrations.
The Hirer must not run machines dry; operate pumps or motors without adequate water; allow filters to become blocked through failure to perform normal operator checks; permit chemical backflow or cross-contamination; use equipment on unsuitable surfaces; leave chemicals in tanks or hoses for extended periods; expose electrical components to water through improper use or storage; or operate beyond rated capacity or pressure limits.
The Hirer must not modify, alter, dismantle, bypass safety systems, perform repairs or arrange third-party repairs without prior written approval from Zintra Equipment. If repair or adjustment is required, the Hirer must contact Zintra Equipment before attempting any repair.
Damage identified during the post-rental inspection that is reasonably consistent with misuse may be charged to the Hirer.
Where equipment is supplied with fuel, including diesel-powered equipment, it must be returned with the same fuel level recorded at handover unless otherwise agreed in writing. If returned below that level, Zintra Equipment may charge for the fuel required to restore the recorded level together with any disclosed refuelling charge.
Battery-powered equipment must be operated and charged in accordance with manufacturer requirements and Zintra Equipment instructions. Unapproved chargers or charging equipment must not be used.
Any charger supplied with the equipment must be returned with the machine. Missing or damaged chargers may be charged at their reasonable replacement or repair cost.
All supplied accessories remain the property of Zintra Equipment. This may include chargers, keys, hoses, brushes, pads, pad holders, filters, squeegee assemblies, blades, cables, adapters and other accessories recorded at handover.
The Hirer is responsible for returning all supplied accessories. Missing or damaged items may be charged at their reasonable repair or replacement cost.
Consumable items and chemicals are not included in the standard rental unless specifically stated or agreed in writing.
Equipment must be returned in a reasonably clean condition, with tanks emptied and free from excessive dirt, sludge, chemicals, waste or other contamination.
A minimum $150 cleaning fee may apply where equipment is returned with dirty tanks, sludge, excessive contamination or otherwise requires cleaning beyond Zintra Equipment's normal turnaround preparation.
Additional cleaning charges may apply where the cleaning required exceeds the minimum charge. The Hirer will be notified of the charge before it is deducted from the security bond.
The Hirer is responsible for damage caused to property, premises or third parties arising from the Hirer's use of the equipment, subject to applicable law.
The Hirer is strongly advised to hold current public liability insurance and any other relevant insurance coverage before taking possession of the equipment.
To the maximum extent permitted by law, Zintra Equipment's liability arising from or in connection with the rental is limited as permitted under applicable law.
To the maximum extent permitted by law, Zintra Equipment will not be liable for indirect, consequential or economic loss, including loss of profits, loss of business or project delays arising from the use, breakdown or unavailability of equipment.
Nothing in these Terms & Conditions excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.
To the extent permitted by law, the Hirer is responsible for injury, damage, loss or claims arising from the Hirer's possession, operation or misuse of the equipment.
Where the Hirer is a company or organisation, the person accepting these Terms confirms they are authorised to bind that entity. Any personal guarantee or personal liability arrangement must be separately and expressly agreed where applicable.
This agreement is governed by the laws of Victoria, Australia. Any dispute arising from this agreement is subject to the jurisdiction of the courts and tribunals of Victoria, subject to any applicable law.
